PAULDING COUNTY COMMISSIONERS MEETING MINUTES 12/19/18

This 19th day of December, 2018, the Board of County Commissioners met in regular session with the following members present: Tony Zartman, Roy Klopfenstein, Mark Holtsberry and Cindy Peters, Clerk

ALLOWANCE OF CLAIMS

Warrants documented as 247827 through 247919 for County Bills were approved and certified to the County Auditor for payment.

IN THE MATTER OF APPROVING ‘THEN AND NOW’ PURCHASE ORDERS AND PAYMENTS

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on December 12, 2018, Warrants numbered 247574 through 247729 in the amount of $237,157.36; and

WHEREAS, it is certified that both at the time that the contract or order was made (“then”), and at the time that the County Auditor is completing the certification (“now”), that sufficient funds were available or in the process of collection, to the credit of a proper fund, properly appropriated and free from any previous encumbrance; and 

WHEREAS, pursuant to the Ohio Revised Code §5705.41(D)(1), these purchases must be approved by resolution of the Board of County Commissioners; now, therefore

BE IT RESOLVED, that the Paulding County Commissioners approve the Then and Now Purchase Orders as submitted by the Auditor; and

BE IT FURTHER RESOLVED, that it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section §121.22 of the Ohio Revised Code.

IN THE MATTER OF SELECTING A NEWSPAPER OF GENERAL CIRCULATION FOR REQUIRED LEGAL PUBLICATIONS

WHEREAS, whenever a political subdivision of the state is required by law to make any legal publication in a newspaper, the newspaper shall be one of general circulation; and

WHEREAS, the Paulding County Prosecuting Attorney has deemed that both the West Bend and the Paulding County Progress meet the criteria for a newspaper of general circulation; and

WHEREAS, upon receiving quotes from both newspapers and following the general practice of accepting the lowest bid, it was recommended to accept the bid from the West Bend News; now, therefore

BE IT RESOLVED, that the Board of County Commissioners does hereby agree to utilize the West Bend News, PO Box 1008, 101 North Main Street, Antwerp, OH 45813 as their newspaper of general circulation for the calendar year 2019.

IN THE MATTER OF AWARDING THE BID FOR THE VILLAGE OF MELROSE STATE AND PAULDING STREETS RECONSTRUCTION PROJECT-PY2017 CDBG CRITICAL INFRASTRUCTURE PROGRAM

WHEREAS, on November 26, 2018, bids were received for the Village of Melrose State and Paulding Streets Reconstruction Project; and

WHEREAS, after review of the aforementioned proposal, the Village of Melrose, Access Engineering Solutions, LLC and Maumee Valley Planning Organization has recommended that the project be awarded to Hohenbrink Excavating, LLC of Findlay, OH, in the amount of $680,281.30; and

WHEREAS, that the Village of Melrose has been awarded CDBG funds in the amount of $250,000.00, Paulding County RLF $30,000.00 and leveraged funds of $420,000.00 has been allocated toward the project; now, therefore

BE IT RESOLVED, that the Board of County Commissioners does hereby award the PY 2017 CDBG Critical Infrastructure Village of Melrose State and Paulding Streets Reconstruction Project to Hohenbrink Excavating, LLC of Findlay, OH in the amount of $680,281.30.

IN THE MATTER OF ENTERING INTO A MEMORANDUM OF UNDERSTANDING WITH THE PAULDING COUNTY ENGINEER, PAULDING EXEMPTED VILLAGE SCHOOL, ANTWERP LOCAL SCHOOL AND WAYNE TRACE SCHOOL

WHEREAS, The Board of County Commissioners are the owners of a 400 foot tower with a trunking system located on Fairgrounds Avenue in Paulding, Ohio; and

WHEREAS, the Paulding County Engineer, Paulding Exempted School (PEVS), Antwerp Local School (ALS) and Wayne Trace School (WTS) desire to use the trunking system on the tower owned by the Commissioners to facilitate communications for their respective entities; and

WHEREAS, the Paulding County Commissioners agree to permit the Paulding County Engineer, PEVS, ALS, AND WTS to use the trunking system on the 400 foot tower. Commissioners agree to be responsible for maintenance of the 400 foot tower; and

WHEREAS, the Paulding County Engineer, PEVS, ALS, and WTS shall be responsible for all maintenance for the trunking system; now, therefore

BE IT RESOLVED, that the Board of County Commissioners does hereby enter into a Memorandum of Understanding with the Paulding County Engineer, PEVS, ALS, and WTS for use and maintenance of the trunking system of the 400 foot tower located on Fairground Avenue in Paulding, OH.  This agreement shall become effective on December 19, 2018 and shall terminate by any of the parties giving thirty (30) days written notice to the other parties of its intent to cancel.

Meeting Notes of Appointments

• Lou Ann Wannemacher, County Treasurer – Ms. Wannemacher presented her investment report as of November 27, 2018.  Estimated Investment interest for 2018 came in at $243,479.57, which is $113,479.57 over estimated revenue.  5% delinquencies on real estate taxes.

• Aaron Timm, Engineer Superintendent – Mr. Timm gave his support to help with the cemetery memorial at the old county home.   Mr. Timm then presented a Memorandum of Understanding to the Commissioners of signed parties for the Radio Tower. (See resolution above).   He commented that the condition of the tower shack has improved and has been cleaned and emptied out.  The propane tank will have a concrete base to keep animals out and a weekly site inspection will be conducted.  Mr. Timm also noted that the power to the tower will need to be shut off for about an hour sometime in the summer to do some maintenance. 

• Amy Hoffman, Palmer Energy – Ms. Hoffman presented the renewal application for Electric Governmental Aggregators for signature.
