PAUDLING COUNTY COMMISSIONERS MEETING MINUTES 11/21/18

This 21st day of November, 2018, the Board of County Commissioners met in regular session with the following members present: Roy Klopfenstein, Mark Holtsberry and Cindy Peters, Clerk absent:  Tony Zartman

ALLOWANCE OF CLAIMS

Warrants documented as 246962 through 247049 for County Bills were approved and certified to the County Auditor for payment.

IN THE MATTER OF APPROVING ‘THEN AND NOW’ PURCHASE ORDERS AND PAYMENTS

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on November 19, 2018, Warrants numbered 246844 through 246919 in the amount of $3677.08; and

WHEREAS, it is certified that both at the time that the contract or order was made (“then”), and at the time that the County Auditor is completing the certification (“now”), that sufficient funds were available or in the process of collection, to the credit of a proper fund, properly appropriated and free from any previous encumbrance; and 

WHEREAS, pursuant to the Ohio Revised Code §5705.41(D)(1), these purchases must be approved by resolution of the Board of County Commissioners; now, therefore

BE IT RESOLVED, that the Paulding County Commissioners approve the Then and Now Purchase Orders as submitted by the Auditor; and

BE IT FURTHER RESOLVED, that it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section §121.22 of the Ohio Revised Code.

IN THE MATTER OF AMENDING THE 2018 ANNUAL APPROPRIATION (FUND 078)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to amend the 2018 Annual Appropriation by appropriating the following in the Infrastructure Projects Fund (Fund 078), to-wit; 078-001-00001/Infrastructure Projects/Infrastructure Expense AMOUNT: $112,010.62

 IN THE MATTER OF SUPPLEMENTAL APPROPRIATION (FUND 078)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to make a Supplemental Appropriation in the Infrastructure Projects Fund (Fund 078); to-wit: FROM: Pay-in #119754  TO: 078-001-00001/Infrastructure Projects/Infrastructure Expense AMOUNT: $31,764.31

IN THE MATTER OF AMENDING THE 2018 ANNUAL APPROPRIATION (FUND 010)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to amend the 2018 Annual Appropriation by appropriating the following in the Soil Conservation Fund (Fund 010), to-wit; 010-001-00011/Soil Conservation/Insurance AMOUNT: $3000.00

IN THE MATTER OF AMENDING THE 2018 ANNUAL APPROPRIATION (FUND 034)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to amend the 2018 Annual Appropriation by appropriating the following in the DARE Fund (Fund 034), to-wit; 034-001-00006/DARE/Other Expenses AMOUNT: $1355.79

RESOLUTION – COMMISSIONER’S ORDER AWARDING CONTRACTS

IN THE MATTER OF THE EAGLE CREEK-WILSON SINGLE COUNTY DITCH NO 26 PETITIONED FOR BY GEORGE HUNT

WHEREAS, The County Engineer has filed with this Board his report on bids received for the work of construction and for furnishing materials in the above named improvement petitioned for by George Hunt; and

WHEREAS, It appears to said Board that the bids of the following are the lowest and best bids and within the County Engineer’s estimate, to-wit: Bidder: Bradford Excavating, 22241 Road 122, Oakwood, Ohio 45873; For What Work of Materials: Work of construction and furnishing materials; Amount of Bid: $98,762.00 County Engineer’s Estimate: $85,210.00 Bidder: Poling Excavating & Waterways, 3728 Convoy Heller Road, Convoy, Ohio 45832; For What Work of Materials: Work of construction and furnishing materials; Amount of Bid: $84,755.00 County Engineer’s Estimate: $85,210.00

RESOLVED, That contracts are hereby awarded to Poling Excavating & Waterways at the amount bid by them, respectively; and be it further

RESOLVED, That the Clerk of the Board of County Commissioners is hereby directed to notify each of said successful bidders of the acceptance of the Poling Excavating & Waterways bid, and that he is required to enter into contract and bond as provided by Sections 6131.41 and 6131.42 of the Ohio Revised Code; and be it further

RESOLVED, That the County Engineer is hereby directed to prepare the contracts and bonds and, having secured the signatures of the bidders and their sureties, present the same to this Board for approval; and be it further

RESOLVED, That the whole of such work shall be completed and all material furnished on or before the 30th day of September, 2019, provided that the time of furnishing the material and completing the labor shall correspond with the time provided for its use in the progress of the work.

IN THE MATTER OF MODIFYING THE 2018 ANNUAL APPROPRIATION (FUND 013)

BE IT RESOLVED, that the Board of County Commissioners does hereby modify the 2018 Annual Appropriation and hereby directs the Paulding County Auditor to transfer funds in the Ditch Maintenance Fund (Fund 013), to wit; FROM: 013-001-00010/ Ditch Maintenance/Workers’ Compensation TO: 013-001-00006/Ditch Maintenance/Equipment AMOUNT:$156.45

IN THE MATTER OF MODIFYING THE 2018 ANNUAL APPROPRIATION (FUND 032)

BE IT RESOLVED, that the Board of County Commissioners does hereby modify the 2018 Annual Appropriation and hereby directs the Paulding County Auditor to transfer funds in the Certificate of Title (Fund 032), to wit; FROM: 032-001-00007/ Certificate of Title/Travel TO: 032-001-00008/Certificate of Title/Insurance AMOUNT: $1000.00

IN THE MATTER OF SIGNING AN AGREEMENT BETWEEN THE VILLAGE OF HAVILAND AND THE PAULDING COUNTY SHERIFF

WHEREAS, Ohio Revised Code, Section 311.29 authorizes the Sheriff to enter into a contract with a municipal corporation for the performance of police services which a municipal corporation may perform, exercise or render, and

WHEREAS, the Sheriff has adequate and qualified police personnel and equipment to provide said police protection; now therefore;

BE IT RESOLVED, that the Board of County Commissioners does hereby enter into an agreement with The Village of Haviland and the Paulding County Sheriff.  The aforementioned agreement is on file in the Commissioners’ office at 115 North Williams St., Suite B-1 Paulding, OH  45879.

Meeting Notes of Appointments

• Joe Burkard, County Prosecutor – Mr. Burkard met with the Commissioners to discuss the budget for the Prosecutor’s office for 2019.  

• Ed Bohn, EMA Director, Matt McDougall, 911 Coordinator – Mr. Bohn and Mr. McDougall discussed the desire for some citizens that wish to be removed from the Nixle Emergency Alert list.  The EMA Director will take a collection of names and phone numbers to remove citizens from the list of emergency calls.  Mr. Bohn will have a waiver form created for citizens to fill out to have their name removed from the list.  To receive emergency alerts on your cell phone, text your zip code to number 888-777.

• Lou Wannemacher, County Treasurer – Ms. Wannemacher presented her investment reports having $16,746,919.44 invested.  Ms. Wannemacher also discussed her 2019 budget for the Treasurer’s office.

• Claudia Fickel, County Auditor – As of November 21, 2018, the general fund was at $1,600,284.00.  Ms. Fickel noted that the IT Manager is working on putting a program on her employee’s computers to assist with the new phone system.  Ms. Fickel also discussed with the Commissioners her 2019 budget for the Auditor’s office and presented the monthly General Fund Receipts, Sales Tax Revenue through November and the Real Estate and Mobile Home Conveyance Fees report.

• Jerry Zielke, Economic Development Director – Mr. Zielke presented the PCED Director’s Report for Sept-October 2018 for the Commissioners review.

• Sheriff Landers – The Commissioners presented Sheriff Landers his 2019 budget.   Sheriff Landers then presented his 2018 projections and monthly Jail report for the month ending October 31, 2018.  There were 81 male inmates serving 1103 days and 22 female inmates serving 207 days in the month of October for a total of 1310 days served.  Total inmates held were 103.  The average inmates held per day was 42.2 with 35.5 being male and 6.6 female. The average inmates stay per day was 12.7 with 13.6 being male and 9.4 female.  Total meals served for the month of October totaled 3,621 meals.
