PAULDING COUNTY COMMISSIONERS MEETING MINUTES 9/5/18

This 5th day of September, 2018, the Board of County Commissioners met in regular session with the following members present: Tony Zartman, Roy Klopfenstein, Mark Holtsberry and Cindy Peters, Clerk

EXECUTIVE SESSION:

A motion was made by Mr. Mark Holtsberry to go into executive session at 8:52 a.m. with Michael Wehrkamp, County Juvenile/Probate Judge to discuss legal matters.  The motion was seconded by Mr. Roy Klopfenstein. All members voting yea.

At 9:02 a.m. all members present agreed to adjourn the executive session and go into regular session.

IN THE MATTER OF RECEIVING BIDS FOR THE 2018 PAULDING COUNTY ROAD RECLAMATION WITH CEMENT STABILIZATION PROJECT:

This  5th day of September, 2018, being the day advertised in the West Bend News, a paper of general circulation within the County, as per Section 307.86 of the Ohio Revised Code, bids were received and opened for the 2018 Paulding County Road Reclamation with Cement Stabilization Project, to-wit; BIDDER Tenmile Creek Excavating, LLC., PO Box H, Metamora, OH 43540 BID AMOUNT $165,679.61

The Paulding County Engineer’s estimate for the project is $176,000.03. The specifications will be studied with a determination to be made later.

IN THE MATTER OF APPROVING ‘THEN AND NOW’ PURCHASE ORDERS AND PAYMENTS

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on August 13, 2018, Warrants numbered 244507 through 244520 in the amount of $15,062.89; and

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on August 15, 2018, Warrant numbered 244528 in the amount of $2,256.09; and

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on August 20, 2018, Warrants numbered 244708 through 244773 in the amount of $20,085.93; and

WHEREAS, the Paulding County Auditor has certified the following “Then and Now” purchase order number and payment included in the Allowance of Claims on August 22, 2018, Warrant numbered 244814 in the amount of $20,298.20; and

WHEREAS, it is certified that both at the time that the contract or order was made (“then”), and at the time that the County Auditor is completing the certification (“now”), that sufficient funds were available or in the process of collection, to the credit of a proper fund, properly appropriated and free from any previous encumbrance; and 

WHEREAS, pursuant to the Ohio Revised Code §5705.41(D)(1), these purchases must be approved by resolution of the Board of County Commissioners; now, therefore

BE IT RESOLVED, that the Paulding County Commissioners approve the Then and Now Purchase Orders as submitted by the Auditor; and

BE IT FURTHER RESOLVED, that it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section §121.22 of the Ohio Revised Code.

IN THE MATTER OF AMENDING THE 2018 ANNUAL APPROPRIATION (FUND 003)

BE IT RESOLVED, that the Board of County Commissioners does hereby direct the County Auditor to amend the 2018 Annual

Appropriation by appropriating the following in the Health Department (Fund 003), to-wit; 003-001-99991/Health Department/Real Estate Fees AMOUNT: $2,465.40

IN THE MATTER OF MODIFYING THE 2018 ANNUAL APPROPRIATION (FUND 009)

BE IT RESOLVED, that the Board of County Commissioners does hereby modify the 2018 Annual Appropriation and hereby directs the Paulding County Auditor to transfer funds in the Engineer’s Gas Tax (Fund 009), to wit; FROM: 009-001-00011/Engineer Gas Tax/Contract Projects TO: 009-001-00007/Engineer Gas Tax/Materials AMOUNT: $100,000.00

IN THE MATTER OF ENTERING INTO A LEASE AGREEMENT WITH NORTHWESTERN OHIO COMMUNITY ACTION COMMISSION (NOCAC)

WHEREAS, on the 5th day of September, 2018, the Board of County Commissioners entered into a lease agreement with Marsha Yeutter, Coordinator of the Paulding County Senior Center and NOCAC by signing the Lease Agreement for the Northwestern Ohio Community Action Commission, and 

WHERAS, the lease shall automatically renew for additional periods of 12 months each upon the terms and conditions, unless either party notifies the other within 30 days of the expiration that the lease agreement is to be terminated, now, therefore

BE IT RESOLVED, that the Board of County Commissioners entered into a lease agreement with the Northwestern Ohio Community Action Commission (NOCAC), and

BE IT FURTHER RESOLVED, that a copy of aforementioned lease agreement can be viewed in the Paulding County Commissioners office in the basement of the courthouse, 115 North Williams Street, Paulding, Ohio.

Meeting Notes of Appointments

• Sheriff Landers, Joe Burkard and Bryce Steiner met with the Commissioners today to issue a press release regarding the portable, Tactic ID Drug Identification Unit that was recently purchased.  A detailed demonstration was provided by Sheriff Landers.  Press Release:  Paulding County would like to announce that with the continued spread of the drug epidemic, a collaborative effort by the Sheriff, Prosecutor and Commissioners of Paulding County was undertaken to purchase a portable, Tactic ID Drug Identification Unit.  This unit is handheld and utilizes laser technology to identify many chemicals and narcotics.  The purpose of this unit is to identify potential drugs before law enforcement personnel is subject to exposure from handling unknown substances.  Paulding County is the first county in Northwest Ohio to implement the purchase of one of these units.  Part of the funding for this purchase was made possible by fines paid for by folks convicted in Paulding County of drug related crimes. A continued effort will be made by your County to provide necessary equipment to ensure the safety of our personnel and our constituents.  

• Chad Crosby, Engineer’s Office – Mr. Crosby opened the bid for the 2018 Paulding County Road Reclamation w/Cement Stabilization Project.  (See resolution above.)

• Travis McGarvey – Mr. McGarvey announced that the road 123 bridge is now open.  He also informed the Commissioners of the upcoming OPWC sub-committee meeting at the Engineer’s office @ 9:00 a.m. September 26th.  McGarvey noted that his employees are heavily involved in the wind farm road work.  The Eagle Creek Wilson Ditch final hearing is on October 15th.

• CMS Energy Enterprises, Peter Lundquist; Rosa Bushkuhl, Lynn Wilson, and Brad Norden met with the Commissioners while Mr. Lundquist informed them that CMS Energy purchased the Star Wood Wind Farm.  Mr. Lundquist noted that when we acquired the project, we went through a lot of work between the two parties.  We really want to make sure this runs smoothly for you guys as a community.  Our heritage is owning and operating for a long time. Mr. Lundquist informed the group that CMS Energy own a gas/electric utility. Our plan is to grow our portfolio.  This is our first windfarm on our non-regulated side of the business. It is with a major customer of ours, General Motors.  Commissioner Zartman welcomed CMS Energy Enterprises to the community.  We’ve been very fortunate for the other two developers and they’ve been very instrumental in our community.   The wind energy development community has really changed our horizon in many ways.  The turbine revenue has a great impact on our community.  

Ms. Wilson mentioned that we are planning a landowner event on Sept 17th.  If you’re not a landowner and would love to stop by, we will welcome you.  Currently we have not officially changed the name of the wind farm.  We are still NW Ohio Wind Project. Our Motto:  World Class Performance Delivering World Class Service.  Commissioner Klopfenstein explained that we are pushing state legislatures on set-back rules.  We have a real uphill battle.  Every citizen benefits from the wind farms in Paulding County in some way.  

• Becky Suvar, WMEA – Ms.Suvar presented an update from WMEA with several educational presentations scheduled.  Ms. Suvar noted that she is also working on additional presentations.  Ms. Suvar informed the Commissioners that REAL Waste Disposal LLC is suspending their recycle route service.  Real Waste Disposal will still be accepting recyclables at their Oakwood location.  

• D.A.R.E. Officer Deputy Nick Mendez – Officer Mendez updated the Commissioners about the DARE program and how successful DARE summer camp was.  The summer camp at Paulding Middle School included approximately 80 children, including several individuals that volunteered.  Mendez noted that the DARE program is going well and he is pleased to announce that relationships have been formed and the program is making a difference.  Officer Mendez noted that he is looking into doing little things with open gyms and a dodgeball tournament.  Commissioner Zartman commended DARE Officer Deputy Mendez and commented that the Board of Commissioners appreciates the time the he has put into the program.
