Paulding County Commissioners Meeting Minutes 11/20/13
This 20th day of November, 2013, the Board of County Commissioners met in regular session with the following members present:
Fred Pieper, Tony Zartman, Roy Klopfenstein, and Nola Ginter, Clerk
ALLOWANCE OF CLAIMS:
Warrants documented as 203523 through 203635 for County Bills were approved and certified to the County Auditor for payment.
EXECUTIVE SESSION:
A motion was made by Mr. Roy Klopfenstein to go into executive session at 8:10 a.m. with the Paulding County Prosecutor to discuss legal matters. The motion was seconded by Mr. Tony Zartman. All members voting yea.
At 8:18 a.m. all members present agreed to adjourn the executive session and go into regular session.
IN THE MATTER OF APPROVING ‘THEN AND NOW’ PURCHASE ORDERS AND PAYMENTS:
The Paulding County Auditor has certified the following “Then and Now” purchase order numbers and payments included in the Allowance of Claims on November 13, 2013, Warrants numbered 203299 through 203407 in the amount of $6,617.57; and it is certified that both at the time that the contract or order was made (“then”), and at the time that the County Auditor is completing the certification (“now”), that sufficient funds were available or in the process of collection, to the credit of a proper fund, properly appropriated and free from any previous encumbrance; and pursuant to the Ohio Revised Code §5705.41(D)(1), these purchases must be approved by resolution of the Board of County Commissioners. Now, therefore the Paulding County Commissioners approve the Then and Now Purchase Orders as submitted by the Auditor; and it is found and determined that all formal actions of this Board of County Commissioners, County of Paulding, State of Ohio concerning the adoption of this resolution were adopted in an open meeting of this Board of County Commissioners, and that all deliberations of this Board of County Commissioners and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section §121.22 of the Ohio Revised Code.
IN THE MATTER OF SUPPLEMENTAL APPROPRIATION (FUND 041):
The Board of County Commissioners does hereby authorize and direct the County Auditor to make a Supplemental Appropriation for the following:

IN THE MATTER OF AWARDING A CONTRACT FOR 2013/2014 WINTER SNOW REMOVAL:
A snow removal proposal for 2013/2014 winter snow removal contract was received from Solid Ground LLC, an insured groundskeeping service to maintain removal of snow accumulations for the 2013/2014 winter season at the location referred to as Paulding County Courthouse; and Solid Ground LLC will remove snow from all concrete walkways and steps as needed and will also apply sidewalk safe ice melter on said areas in conjunction to, or separate thereof, snow removal; and Payment Option B proposes an hourly rate of $42.00 per man hour, $80.00 per truck hour (for times needed to clear parking spots, not to be used on concrete itself), and $0.43 per pound of concrete safe ice melter, to be billed monthly. Now, therefore the Board of County Commissioners does hereby accept Payment Option B and does enter into contract with Solid Ground LLC for the removal of snow accumulations at the Paulding County Courthouse for the hourly rate of $42.00 per man hour, $80.00 per truck hour (for times needed to clear parking spots, not to be used on concrete itself), and $0.43 per pound of concrete safe ice melter, to be billed monthly through the natural winter season of 2013/2014.
EXECUTIVE SESSION:
A motion was made by Mr. Roy Klopfenstein to go into executive session at 2:34 p.m. with the Paulding County Prosecutor; and Randy Derck and Jerry Zielke, Paulding County Economic Development to discuss legal matters. The motion was seconded by Mr. Fred Pieper. All members voting yea.
At 3:02 p.m. all members present agreed to adjourn the executive session and go into regular session.
Meeting Notes of Appointments:
Ann Pease, Clerk of Courts – Ms. Pease met briefly with the Commissioners to update them on the Clerk’s Office and the Title Office.
Travis McGarvey, County Engineer – Mr. McGarvey met with the Commissioners to discuss the right-of-way policy as it pertains to ditch maintenance. Radio communication for Latty Township was also discussed. Mr. McGarvey also updated the Commissioners on some fall road projects. The Commissioners expressed their appreciation for the transporting of one of the sewer generators to pump station #3 during the recent power outage. Mr. McGarvey noted he put 50 gallons of diesel fuel in the generator.
Tom Miller, Assistant Fire Marshal – phone conference – The Commissioners were able to talk to Mr. Miller on a conference call. Mr. Miller answered questions regarding the difference between a Fire Prevention Officer and a Certified Fire Safety Inspector. In his capacity as Assistant Fire Marshal, he may inspect nursing homes, retail fireworks establishments, and schools. He also informed the Commissioners that subdivisions may appoint a fire safety inspector.
Ryan Mapes, SWCD; and Travis McGarvey, County Engineer – Mr. Mapes had questions on the permanent 25 foot easement for ditch maintenance purposes. He explained a current dip-out project that resulted in excessive dirt that needs leveling. The contractor wants to make sure he follows the easement ruling. Mr. Mapes was advised to make sure the landowners and farming tenants understand the need to exceed the right of way for the purpose of leveling the dirt.
Corey Walker, Director, Defiance/Paulding County Department of Job & Family Services – Mr. Walker met with the Commissioners to discuss the procedure to paying the Jacob-Eaton Children’s Home bills in lieu of the recent merger of Defiance and Paulding County JFS. Mr. Walker also commented the remodeling project at Paulding County’s new office location on Dooley Drive is progressing. He anticipates making arrangements for moving and a security system soon. Mr. Walker also reported Paulding County JFS’s monitoring was recently completed.
